1. CONDITIONS OF USE

This contract describes the “Terms and Conditions” that regulate the navigation and use of the website www.carlosefrainm8.sg-host.com and its subdomains, property of PUFF CLEANING AND REPAIR HOLDINGS LLC, a company domiciled in the city of Miami – Florida, United States of America (hereinafter the CONTRACTOR), whose corporate purpose is the exploitation of the cleaning industry in all its manifestations; establishment of stores and agencies for the sale of cleaning supplies, as well as the import and sale of the same; supply and sale of floor waxes, soaps, polishes and stain removers, and other items related to the needs of the cleaning service; the rendering of Outsourcing and Process Outsourcing services in all the activities that have as purpose the exploitation of the cleaning object; maintenance of office equipment; rendering of painting, plumbing, electricity, carpentry services in constructions in houses and buildings, but it may also engage in other acts or legal contracts, whether or not of commerce, supply of drivers for private vehicles.

1.1 GENERAL PROVISIONS

The TERMS OF USE regulate the contractual relationship of provision of services between the CONTRACTOR and the USER of the site that acquires one or more services of (I) Cleaning Solutions for Homes, Airbnb, Offices, Warehouses, Premises, Restaurants, and other spaces of possible cleaning: (1) General cleaning services, (2) Deep cleaning services including machinery, (3) Specialized solutions, cleaning of rugs, cleaning of sofas, cooking, washing, drying, ironing, folding, etc.

1.2 LEGAL CAPACITY

The services are only available to persons and companies with the legal capacity to contract. The services may not be used by persons who do not have such capacity or minors. The acts that they perform on this site will be the responsibility of their parents, guardians and therefore are considered performed by them in the exercise of the legal representation with which they have. Whoever registers a USER as a company must have the capacity to contract on behalf of such entity and to bind it under the terms of this agreement.

1.3 SERVICES OFFERED

1.3.1 CLEANING SOLUTIONS

1.3.1.1 GENERAL HOUSEKEEPING SERVICES FOR HOMES AND CORPORATIONS

PUFF CLEANING AND REPAIR HOLDINGS LLC offers you, through the Website and its subdomains, the possibility to purchase an hourly cleaning service for companies (micro, small, medium, large), homes, warehouses, Airbnb, etc., upon reservation and payment of the same. The cleaning activities included in the contracted service are detailed below:

1.3.1.2 CLEANING OF HOMES

1.3.1.2.1 WHAT IT INCLUDES

Common areas (hallways, entrance hall, living room, and dining room): (1) general cleaning (sweeping, mopping, and/or vacuuming), (2) dusting furniture, (3) non-fragile decorative objects, (4) televisions, (5) lamps and light fixtures that are not higher than 1.50 meters from the floor, (6) cleaning walls and doors, (7) throwing garbage away and changing bags.
Kitchen cleaning: (1) General kitchen cleaning (sweeping, mopping), (2) External cleaning of extractor hoods, (3) Basic degreasing of surfaces, (4) Washing, drying and storage of dishes, (5) Cleaning of kitchen countertops, (6) Cleaning of exterior refrigerator doors, (7) Exterior cleaning of oven, (8) Cleaning of countertops and furniture.
Room cleaning: (1) General room cleaning, (2) Bed making, (3) Picking up dirty clothes and placing them in storage for the purpose, (4) Exterior cleaning of furniture, (5) Sweeping and/or vacuuming, (6) Dumping garbage and changing bags, (7) Sweeping and vacuuming, (8) Does not include internal closet cleaning.
Bathroom Cleaning: (1) Cleaning and disinfection of the bathroom area, (2) Cleaning of mirrors, (3) Cleaning of sinks, (4) Cleaning of tub/shower, (5) Basic degreasing, (6) Cleaning of surfaces, (7) Sweeping and mopping, (8) Garbage disposal and bag change, (9) Aromatization of bathrooms.
Washing and Drying of Clothes: (1) Sorting and washing clothes by texture and colors, (2) Clothes drying / domestic dryer, (3) We remind you that the average normal washing cycle in an automatic washing machine is 1.2 hours for a full load and the recommended drying cycle is 45 minutes so that the clothes do not come out as dry and allow for easy ironing.
Ironing and Folding at assigned sites: (1) Estimated ironing performance per hour: Eight garments, (2) Includes maximum 4 hours of ironing.
Our 4-hour service: It is recommended for apartments or offices up to 60 square meters, so the service routine can be fully executed.

1.3.1.2.2 SERVICE EXCLUSIONS

Supply of specialized machinery for removal of excess grease, dirt or fungus from kitchen, bathrooms or walls.
Food handling.
Specialized floor treatment, carpet, curtain and rug washing.
Cleaning at heights above 1.50 meters above the floor. Work at heights is defined as work at heights.
Movement of furniture weighing 20 kilos or more.
Gardening and specialized internal and external plant management.
Realization of Domiciles.
Use of acids or highly corrosive chemical agents.
NOTE: In case of requiring a specialized cleaning, the USER may do so by contracting a specialized cleaning through the web page www.carlosefrainm8.sg-host.com and its subdomains option specialized services.

1.3.1.3 CORPORATE CLEANING (OFFICES, COMMERCIAL PREMISES, BUSINESSES)

1.3.1.3.1 WHAT IT INCLUDES

Common Areas: (1) Cleaning of corridors, (2) Meeting Room, (3) Filing areas and other common areas, (4) Cleaning and care of chairs, furniture and tables, (5) General cleaning of blinds, curtains, blackout, among others, (6) Cleaning of windows and interior glass of offices, modules, meeting rooms, common areas and doors, (6) Cleaning of walls, railings, stairs, walls and modular divisions, (7) Cleaning of decorative elements, pictures, lamps and luminaries that are not in a height higher than 1.(9) Cleaning and watering of plants and interior gardens and watering of exterior office gardens, (10) Cleaning of elements, equipment and utensils used for the cleaning service.
Offices: (1) Cleaning of offices, partitions, desks, tables, books, pictures, decorative objects, shelves, shelves, file cabinets and drawers. (2) Exterior cleaning of computers, telephones, printers, photocopiers and other administrative equipment.
Bathrooms: (1) Cleaning and disinfection of toilets, urinals, sinks, faucets, dispensers, dryers, accessories, mirrors, walls, doors and partitions, floors and wastebaskets, (2) Aromatization of bathrooms, (3) General degreasing.
Floors and upholstery: Cleaning, washing and vacuuming of carpets, rugs and upholstery.
Exterior areas: Cleaning of patios, sidewalks, entrances, gardens, green areas and areas surrounding the office.

1.3.1.3.2 SERVICE EXCLUSIONS

Use of specialized machinery to remove excess grease, dirt or fungus from kitchen, bathrooms, or walls in case of general cleaning.
Food handling.
Deep cleaning of floors, carpets, curtains, rugs, among others in general services.
Special floor treatment.
Cleaning at heights higher than 1.50 meters above the floor. This is defined as work at heights.
Movement of furniture weighing 20 kilograms or more.
Gardening and specialized plant management.

1.3.1.4 SERVICE DURATION

At the time of booking, the USER agrees with the CONTRACTOR the duration of the service. The duration of the service cannot be modified without express acceptance by the CONTRACTOR. The cleaning activities requested shall be performed at the contracted times and in the order indicated by the USER. In the case that the totality of the required activities exceeds the time contracted for their performance, the USER may hire a new service or hire two or more cleaning experts on the same day.

1.3.1.5 ASSIGNMENT OF GENERAL CLEANING SERVICES

PUFF CLEANING SERVICES LLC may assign the USER a different cleaning expert than the one selected, who can comply with the time and service booked. During the reservation, the USER indicates to the CONTRACTOR the duration of the service, start time and cleaning activities to be performed. The activities shall be performed within the contracted times. In the case that the cleaning expert is unable to perform all the activities required by the USER, the USER shall contract a new service.

1.3.1.6 CLEANING PRODUCTS, MACHINERY AND UNIFORMS

When available, the grooming products purchased through the site are subject to the shipping and delivery conditions chosen by the User and available on the site. The information on the place of shipment is the sole responsibility of the User. The terms chosen for dispatch and delivery are counted from the moment the purchase order and the means of payment used have been validated, and are considered working days for the fulfillment of said term. Orders will be dispatched within a maximum of 10 working days after the sale is finalized. Before finalizing the purchase, the user will be able to know the range of dates for the estimated delivery of the product, likewise the products will only be delivered Monday through Friday from 8 a.m. to 5 p.m., excluding Saturdays, Sundays and holidays. Orders placed after 4:00 p.m. will be processed the next business day.
The user may choose at the time of purchase to have the product shipped to a specific location. The User acknowledges and agrees that the location data provided for www.carlosefrainm8.sg-host.com / PUFF CLEANING AND REPAIR HOLDINGS LLC and licenses to deliver the products purchased through the site are true and current. Therefore, the user voluntarily declares that by providing such data, irrevocably AUTHORIZES the person who at the time of delivery is at the address provided by the user to receive the product. By virtue of the foregoing whoever is at the address indicated by the user and declares in good faith his or her willingness to receive the products, shall act for and on behalf of the user and therefore PUFF CLEANING AND REPAIR HOLDINGS LLC, LICENSORS or their contractors shall be empowered to deliver the products purchased through the site. This authorization includes, but is not limited to, persons who continuously or temporarily occupy positions such as doormen of buildings and co-ownerships, domestic service employees, janitors and in general any person who at the time of delivery states that he/she is authorized to receive the products. Therefore, PUFF CLEANING AND REPAIR HOLDINGS LLC, its licensors or its contractors (its affiliates) shall not be liable for any loss or damage to the products once they have been duly delivered to the address provided by the User. PUFF CLEANING AND REPAIR HOLDINGS LLC, its licensors or its contractors shall be exempt from liability as long as it can prove that the products have been delivered to the address provided by the User.

NOTE: The delivery of products, machinery and cleaning uniforms apply only to sectors or areas authorized by the holding company. The photos of the products are representations of them and may vary in image but not in quality and quantities.

1.3.1.6.1 PRODUCT RETURN POLICY, RIGHT OF WITHDRAWAL, WRONG PRODUCT CLAIM CONDITIONS AND REVERSAL OF PAYMENT TO

PUFF CLEANING AND REPAIR HOLDINGS LLC

Licensors, or its contractors, offers its customers the possibility to retract the purchase during the first 24 hours after delivery of the product. PUFF CLEANING AND REPAIR HOLDINGS LLC, Licensors or its contractors will respond to this request within 15 business days of the request. In order to exercise the right of withdrawal, the product must be in the same condition in which it was delivered, it must not be damaged or deteriorated by actions corresponding to customers, it must have labels, sales invoice, accessories and packaging, it must not show signs of use, dirt or wear.

1.3.2.1 CANCELLATION OF SERVICES

1.3.2.1.1.1 NON-CANCELED RESERVED SERVICES

No service shall be performed until the payment for such services has been made and confirmed. In the event that the CONTRACTOR does not provide a service previously paid by the USER, the latter shall return the value agreed in the PURCHASE ORDER of the service not provided, for which purpose a written procedure shall be established for the return of the money or for a new scheduling of a service.

1.3.2.2.5.2 PAYMENT CHANNELS

A USER may use through a third party (electronic payment platform) different means of electronic payments such as: ZELLE Transfer and Credit or Debit Card.

2. REGISTRATION AND USE OF THE SITE

It is mandatory to complete the registration form in all its fields with valid data to become an authorized USER, to access promotions and to purchase services and/or products offered on this site. The data provided by the USER must be accurate, precise and true, and the USER undertakes to update the PERSONAL DATA as necessary. PUFF CLEANING SERVICES LLC is not responsible for the accuracy of the PERSONAL DATA provided by users. Users guarantee and are responsible, in any case, for the accuracy, truthfulness, validity and authenticity of the personal data entered. If fraudulent and/or malicious and/or contrary to these Terms and Conditions and/or contrary to good faith use is verified or suspected, PUFF CLEANING SERVICES LLC shall have the right to terminate the accounts and proceed with the appropriate legal actions.
3. RESERVATION OF SERVICES
The USER of the site may book one or more days of General Cleaning services offered by PUFF CLEANING AND REPAIR HOLDINGS LLC, licensors or their contractors, for this purpose may do so by filling out the application form provided on the Site and / or Application. Likewise, you can do so by contacting the Contact Center or through the Social Networks of PUFF CLEANING AND REPAIR HOLDINGS LLC, licensors or their contractors and/or chat, where you must provide some basic information to make the Reservation (hereinafter, “PURCHASE ORDER”), which will be sent to the email address provided by the USER.

PRICE OF THE SERVICE

4.1 PRICE CHANGE

The prices of the services offered for the home segment, Airbnb are published on the website and / or mobile application. The reservation, which will be kept by the CONTRACTOR.  PUFF CLEANING AND REPAIR HOLDINGS LLC, licensors or its contractors may unilaterally change the prices of its services at any time, without prior notice to its customers. This price variation applies to future bookings only. The value agreed in the PURCHASE ORDER must be paid prior to the completion of the established tasks. The price of the services and/or products available on the site corresponds to US dollars.

4.2 INVOICING

PUFF CLEANING AND REPAIR HOLDINGS LLC, its licensors or its contractors will generate an invoice according to the terms of law in force in the United States of America which will be sent only by email indicated by each USER.

5. PROMOTIONS

The promotions offered on this Website are not necessarily the same as those offered by other sales channels used by the companies, such as telephone sales, App, and/or Social Networks, unless expressly stated on this site or in the advertising made by the companies for each promotion. PUFF CLEANING AND REPAIR HOLDINGS LLC, licensors or their contractors manage their promotions and promotional activities, in the action of complying with the current regulations and specific provisions of the LAW.
The term of validity of the offer is that which coincides with the effective date indicated in the promotion or by virtue of the exhaustion of the quantities of services and/or products available for that promotion duly informed to the user, or as long as the offer remains available. When a promotion does not indicate a termination date, it will be understood that the activity will be extended until the exhaustion of the corresponding products or services.

6. PAYMENT SERVICES

6.2 PAYMENT CHANNELS

A USER may use through a third party (electronic payment platform) different means of electronic payments such as: Zelle Transfer, Credit Card, Debit Card. The use of credit cards shall be subject to what is established in the Terms and Conditions and in relation to its Issuer, and to what is agreed upon in the respective opening contracts and Rules of Use. In case of contradiction, what is expressed in the latter instrument shall prevail. In the case of Bank Cards accepted in the Site, the aspects related to them, such as the date of issue, expiration, quota, blocking, etc., shall be governed by the respective Opening Contract and Regulation of Use, in such a way that the Companies shall not be liable for any of the aspects indicated. The Site may indicate certain purchase conditions according to the means of payment used by the user. The CONTRACTOR uses an electronic payment platform of a third party, therefore, it is not responsible for any inconvenience, delay or non-compliance by these payment platforms.

6.3 REVERSAL OF PAYMENT

The customer may request the reversal of the payment of a service and/or product directly with his bank. Reversal of payment may be requested if the customer was the object of fraud, if the payment corresponds to an operation not requested by the customer, if the product and/or service does not correspond to the one requested by the customer if the product does not meet the inherent characteristics or is defective.
To request a reversal of payment, the customer must make a request to PUFF CLEANING AND REPAIR HOLDINGS LLC, licensors or their contractors within 3 (Three) business days from the date the customer became aware of the fraud of the unsolicited transaction or experienced the inconvenience with the purchased product.
When the payment corresponds to several services and/or products, the customer may request the partial reversal of the payment of those for which the request is made, for which the customer must clearly state the product and the value for which the reversal is requested.
Once the complaint is filed with PUFF CLEANING AND REPAIR HOLDINGS LLC, licensors or their contractors and the request for reversal is filed with the issuer of the payment instrument, they will have a term of 15 business days to make the reversal effective.

7. QUALITY ASSURANCE

The CONTRACTOR undertakes to perform the cleaning and/or specialized cleaning tasks with the highest standards of quality and professionalism, ensuring at the same time the safety of the client and the safety and health at work of its CLEANING AND CLEANING EXPERTS. In the case that THE USER is not satisfied with the service provided or considers that the CONTRACTOR has not complied with the specifications of the PURCHASE ORDER, the USER must communicate in writing to info@puffcleaning, with its non-conformity to the CONTRACTOR within 48 hours after the termination of the service, specifying in detail the reasons for its non-conformity. In response to this communication, the CONTRACTOR shall send the USER a non-conformity report form, which the USER shall have to compile within 48 hours after receiving it, specifying in detail the evidence of the facts that occurred. Once the non-conformity form is received, the CONTRACTOR has 5 working days to respond to the USER’s non-conformity report. Depending on the result of its investigation, the CONTRACTOR shall not be obligated, but may voluntarily decide to offer a new service to the USER or to fully or partially reimburse the price of the service in question. The decision must be communicated in writing to the USER.

8. LIABILITY FOR INCONVENIENCES OCCURRING DURING THE SERVICE

In the event of a potential inconvenience occurring during the performance of the cleaning service and/or specialized service, the USER must notify the CONTRACTOR in writing at info@(City where you are using the service).carlosefrainm8.sg-host.com within 48 hours after the occurrence of the damage. In response to this communication, the CONTRACTOR shall send the USER an inconvenience report form, which the USER shall have to send within 48 hours of receipt, specifying in detail the evidence of the events that occurred. The CONTRACTOR has 5 business days to respond to the USER’s inconvenience report, informing the USER the result of the investigation of the event occurred and communicating the Company’s decision to acknowledge total or partial liability for what happened. In case of recognizing total or partial responsibility for the reported inconvenience, the CONTRACTOR may decide to reimburse up to 100% of the commercial value of the reported inconvenience through a credit in future reservations with the COMPANY or through a cash refund. The decision will be communicated by e-mail to the USER. Once the communication of the CONTRACTOR’s decision is received, the USER shall have 5 business days to accept the proposed resolution of the case or reach an alternative agreement with the COMPANY, otherwise the case shall be considered resolved, and the CONTRACTOR shall be considered in good standing.
The CONTRACTOR shall not be liable, in any case, for damages caused by acts of God and/or force majeure. The CONTRACTOR shall not be liable in case of damage to objects owned by the USER due to natural wear and tear.

8.1. CASES IN WHICH THE SERVICE WILL NOT BE PROVIDED:

THE CONTRACTOR shall not provide the service, nor shall there be a refund of the money, in the following cases listed, but not limited to: The CONTRACTOR shall not be liable, in any case, for damages caused by acts of God and/or force majeure. The CONTRACTOR shall not be liable in case of damage to objects owned by the USER due to natural wear and tear.
  1. Mistreatment, discriminatory or cruel treatment against sexual orientation, skin color, dignity, nationality, of the service provider. 
  2. Cases in which the dignity, health, integrity or life of the service provider is compromised or at risk, such as but not limited to, use of flammable elements in the place that cannot be avoided, dangerous animals, psychoactive substances, activated weapons or in danger of being activated, condition of the property that threatens ruin or destruction, accumulation of objects and/or dead or live animals arranged in such a way that it is dangerous to walk through the property, among others.
  3. Scenes in which it is evident or suspected that criminal activities have been, are being or are about to be committed, in which case, the USER accepts that THE CONTRACTOR is obliged to inform the pertinent authorities. 

9. PROCESSING OF PERSONAL DATA

9.1 USER DATA

CLEANING EXPERT DATA: The USER will be able to consult the data of the assigned cleaning personnel (ID, background, among others) in order to know the person who will provide the service at the agreed site.

10. DATA PROCESSING AND PURPOSE OF THE DATA

PUFF CLEANING AND REPAIR HOLDINGS LLC, its licensors or its contractors may transfer and/or transmit the personal data subject to processing to companies that are part of its corporate group, that is, to parent companies, affiliates and subsidiaries. It may also provide information to suppliers (advertising agencies) and subcontractors to support activities such as delivery of promotional services, collection of payments, shipment of products or outsourcing of customer service systems. Likewise, exchange information with third parties for fraud protection and credit risk reduction purposes. Transfer databases to third parties in case of sale of the site. Share personal data collected to third parties that have the quality of business partners so that together with PUFF CLEANING AND REPAIR HOLDINGS LLC, licensors or their contractors, they can offer products and / or services to improve the value of the Services and / or Products offered. Other than as set forth in this Privacy Policy, we may not sell or disclose your personal information to third parties without obtaining your prior consent, unless it is used for the purposes set forth in this Privacy Policy, or we are required to do so by law.

11. APPLICABLE LEGAL FRAMEWORK

or all legal purposes, the parties hereby establish as contractual domicile the State of Florida. This agreement is governed by the law of the State of Florida. These TERMS OF USE shall be construed and enforced exclusively in accordance with the laws of the State of Florida, USA. Any dispute arising out of or as a consequence of the application of these TERMS OF USE shall be resolved by the jurisdiction of the State of Florida.

12. MODIFICATIONS TO CONDITIONS OF USE

PUFF CLEANING AND REPAIR HOLDINGS LLC, licensors or their contractors reserve the right to unilaterally modify, supplement and/or cancel the Site -App and TERMS OF USE without prior notice.

13. DELIVERY TIMES CLEANING KITS -E-COMMERCE

Delivery of kits purchased through the PUFF CLEANING AND REPAIR HOLDINGS LLC website, to licensors or their contractors, will be delivered within 10 (Ten) business days from the date of purchase, the delivery of which is handled directly by the manufacturer Industry.

14. ENTRY INTO FORCE, MODIFICATION AND PERIOD OF VALIDITY OF THE DATABASES

This policy shall apply as of May 1, 2022.
